Program Description:

In libraries and classrooms, ready access to information is often constrained by restrictions imposed by copyright laws and license agreements with content vendors. The better we understand the laws, the more likely we are to satisfy our patron, student, and faculty information needs. What are the basics of copyright law and digital licensing? What are some of the related controversies? When people or institutions push the envelope of copyright law in order to better facilitate Fair Use for educational purposes, what legal risks are they really taking? Is your institution limiting access more than necessary, or is it in contempt of the law and taking foolish legal risks? This workshop will address these questions and more.

Teaching faculty are invited to join the lunchtime session where copyright issues impacting content creators in a growing digital environment will be discussed.

Copyright & Intellectual Property Rights for Academic, Public, and Special Libraries (Kenneth Crews)

New developments in the law, technology, and library services continue to make copyright a prominent concern. Copyright establishes rights for owners, but it also grants rights of use to the public. Copyright is also the foundation from which we negotiate our creative and productive licenses for access to new resources. In this session, we will build that foundation with a solid understanding of copyright principles and a look at recent changes in the law that can affect librarianship, distance learning, database management, and more.

Licensing Agreements: Finding Balance between Contract & Copyright Law in Your Institution (Trisha Davis)

A license agreement is a grant of rights in the form of a contract that is governed by Contract Law, not Copyright Law. A license only describes the rights granted by the licensor, therefore it is critical that rights normally assumed under Copyright are included in the license terms. This session will address the key issues to assuring that a license in handled properly within the institution, identify license terms that can be troublesome, and suggest methods to find a balance between Copyright and Contract Law.

Bring your questions and join in an overview of key principles and dynamic developments as technology, creative scholarship, and the law struggle to co-exist.

Presenters:

Kenneth Crews is the Samuel R. Rosen II Professor in the Indiana University School of Law-Indianapolis and in the IU School of Library and Information Science. He is also Associate Dean of the Faculties for Copyright Management, and in that capacity he directs the Copyright Management Center based at Indiana University-Purdue University Indianapolis (IUPUI).

Professor Crews brings a variety of academic and professional experiences to his duties at the university. He earned his undergraduate degree in history from Northwestern University and received his law degree from Washington University in St. Louis. He practiced general business and corporate law in Los Angeles from 1980 to 1990, primarily for the entertainment industry. During those years, Crews returned to graduate school and he earned his M.L.S. and Ph.D. degrees from UCLA's School of Library and Information Science.
His principal research interest has been the relationship of copyright law to the needs of higher education. His first copyright book, Copyright, Fair Use, and the Challenge for Universities: Promoting the Progress of Higher Education, was published by The University of Chicago Press in October 1993, and it reevaluated understandings of copyright in the context of teaching and research at the university. A more recent book, Copyright Essentials for Librarians and Educators, published by the American Library Association in late 2000, is an instructive overview of copyright law.
Crews has been an invited speaker on college and university campuses and at conferences in 39 states, D.C., and 7 foreign countries. Crews was during 2003 the Intellectual Property Scholar for the Center for Intellectual Property and Copyright in the Digital Environment, University of Maryland University College, and he currently serves as a faculty member for the Munich Intellectual Property Law Center. Trisha L. Davis is an Associate Professor and Head, Serials and Electronic Resources Department at The Ohio State University Libraries. She also serves as an adjunct faculty member for the Kent State University School of Library and Information Science, Columbus Program, teaching graduate courses in technical services, serials, cataloging, and academic libraries.

Ms. Davis has served as the Visiting Program Officer for Licensing of Electronic Products at the Association of Research Libraries for whom she has developed a two-day workshop on licensing that has been presented around the U.S. since fall 1997. She remains actively involved in committee work for the American Library Association and is a member of the editorial board of Library Collections, Acquisitions & Technical Services (LCATS) and the ALA’s Library Resources and Technical Services (LRTS).

Ms. Davis was awarded the ALA ALCTS 2000 Bowker/Ulrich's Serials Librarianship Award, which recognized her distinguished contributions to serials librarianship. In 2002 she received the ALCTS Presidential Citation for her vision and dedication in developing and presenting “Fundamentals of Acquisitions”, a web-based continuing education course.

Ms. Davis has authored a book on automated serial control systems, and many articles on copyright and licensing issues for electronic products. For the last four years, she has presented papers and given workshops on licensing, copyright, and electronic publishing at a variety of professional meetings
